The instant case is a small amount case as stipulated in Article 2(1) of the Trial of Small Claims Act and Article 1-2 of the Rules on Trial of Small Claims. The Defendants’ assertion in the grounds of appeal is not a ground of appeal as stipulated in any of the subparagraphs of Article 3 of the Trial of Small Claims Act. Therefore, it cannot be a legitimate ground of appeal.
Therefore, all appeals are dismissed, and the costs of appeal are assessed against the losing party. It is decided as per Disposition by the assent of all participating Justices on the bench that there is an obvious clerical error in the indication of the party concerned.
