Examining the reasoning in light of the evidence duly admitted by the first instance court, the lower court was justifiable to have found the Defendants guilty of the instant facts charged on the grounds stated in its reasoning.
There is no error of exceeding the bounds of the principle of free evaluation of evidence in violation of logical and empirical rules, or of misapprehending the legal doctrine on the violation of the Wastes Control
In addition, the Defendant’s act is not a violation of Article 63 of the Wastes Control Act, but a violation of Article 65 subparag. 1 of the Wastes Control Act is established. The Defendant’s ground of appeal asserts that the Defendant’s act is not a reason for appeal or the lower court’s decision is not subject to judgment ex officio, and it does not constitute legitimate
Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
