1. The Defendant shall pay the Plaintiff KRW 100,000,000 and the interest rate of KRW 20% per annum from April 28, 2015 to the date of full payment.
Comprehensively taking account of the overall purport of the arguments in Gap evidence Nos. 1 through 3, the fact that the defendant agreed to the plaintiff on July 29, 2014, "40 million won until August 19, 2014, and 100 million won until September 12, 2014, shall be recognized."
The plaintiff is a person who received payment of KRW 40 million on August 4 of the same year and appropriated to the original claim of the above agreed amount.
Thus, the defendant is obligated to pay to the plaintiff 10 million won the agreed amount and the damages for delay at the rate of 20% per annum under the Act on Special Cases concerning Expedition, etc. of Legal Proceedings from April 28, 2015 to the day following the delivery of a copy of the complaint of this case.
(A) The date of birth shall be governed by the Plaintiff’s claim within the scope of statutory interest. It is so decided as per Disposition by the Plaintiff.
