1. The Defendant’s KRW 159,093,260 for the Plaintiff and KRW 20% per annum from September 25, 2009 to February 14, 2019.
1. Indication of claims: It shall be as shown in attached Form; and
2. Judgment without holding any pleadings (Articles 208 (3) 1 and 257 of the Civil Procedure Act);
3. Pursuant to Article 3(1) main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings for Partial Dismissal (hereinafter “Promotion Act”) (wholly amended by Presidential Decree No. 26553, Sept. 25, 2015; effective Oct. 1, 2015); and Article 2(2) of the Addenda of the same Act, the part of the Plaintiff’s claim seeking delayed interest rate exceeding 15% per annum among the Plaintiff’s claim for delay damages is dismissed.
