The prosecution of this case is dismissed.
Reasons
1. On August 28, 2013, around 23:30 on August 28, 2013, the Defendant: (a) committed assault to the victim D (the age of 40) and the Defendant’s wife before the convenience store in Gangseo-gu Seoul Metropolitan Government, with his hand when booming the victim’s neck, booming the victim’s wife into an irregular tool; and (b) booming the victim’s wife into a booming tool; and (c) assaulting the victim by drinking.
2. However, since the victim expressed his/her intent to withdraw his/her intention to punish the Defendant after the prosecution of this case, the prosecution of this case is dismissed pursuant to Article 260(1) and (3) of the Criminal Act.
