A. On December 1, 2013, the Plaintiff and the Defendant entered into a subcontract with respect to the roof board and the TPO flood control work (hereinafter “instant construction work”) in the name of the Si Corporation (hereinafter “Yanyang system”), a corporation, and the Defendant, among the D works in the budget of the Plaintiff and B, in order to perform the construction work in order to compensate the Plaintiff for the total amount of value-added tax (including the construction cost of KRW 4,120,00,000, value-added tax, and value-added tax) among the instant construction work. The portion of lighting waterproof and TPO flood control (including the construction cost of KRW 4,1220,00,000, and value-added tax) among the construction work in the instant case, the Plaintiff shall be responsible for the total amount of the construction cost, including the Plaintiff’s wage, materials, etc., and the rest of the roof board, wavepet, construction work, etc., the Defendant shall execute and receive the construction cost in lump sum from the present system, and shall pay the Plaintiff the total value-added cost.

B. On December 2, 2013, the Defendant entered into a subcontract for construction works with construction cost of KRW 341 million (including value-added tax) and from December 2, 2013 to December 31, 2013 with respect to the instant construction works (hereinafter “instant subcontract”). After the commencement of construction works on the 10th day of the same month and the completion of construction works on the 23th day of the same month, the Plaintiff purchased lighting flooding materials and carried out the TPP rooftop waterproof construction by mobilization of human resources from mid- January 2014 to mid- February 201, and the Defendant again completed the instant construction works on the site after completing the construction works.

C. On December 26, 2013, the Defendant received KRW 289,9920,000 out of the instant construction cost from the Gayang system, and paid to the Plaintiff KRW 5 million, which is a part of the TPP rooftop construction cost, and KRW 10,60,000,000,000,000,000,000 from January 21, 2014.

The plaintiff is proceeding with the repair of defects at the request of the full-time system.
