The Defendants are not guilty. The summary of the judgment of innocence against Defendant A is published.
1. The indictment of this case is as shown in the annexed sheet.
2. According to the evidence duly examined on basic facts, the following facts may be acknowledged.
(1) A building permit holder is an architect (hereinafter referred to as "agent") or an agent for business affairs related to the approval, etc. of use of a building.
) The F (hereinafter “F”) may act as an agent (excluding buildings subject to reporting. Article 27 of the Building Act and Article 20(2) of the Enforcement Decree of the Building Act) provided that the F (hereinafter “F”) “Business Regulations concerning the appointment of an agent certified architect, etc.” in relation to the said on-site investigation, etc.
According to this, a person who intends to apply for approval of use of a building (a certified architect who performs both ordinary design and supervision as well as supervision shall file an application for designation of an acting architect with F.
(F) Upon receipt of an application for designation, the F shall designate the agent by means of a random lottery, prepare a letter of designation of the agent, and notify the supervisor and the agent architect of the designation.
(Article 7(2) of the above Regulations. After completing an on-site investigation service, etc., an agent architect shall prepare a report on approval for use, investigation and inspection and notify the relevant supervisor thereof.
(Article 9 of the above Regulations). A supervisor applying for the designation of an agent shall pay a certain amount of agency expenses to F.
F shall pay agency expenses to an architect who has completed agency business.
(Article 14 of the above Regulations). (b)
F. F. agent procedure 1) Ordinary architect(s) has accepted and processed design, supervision, and inspection procedure for approval of use as well as design and supervision. As to buildings completed accordingly, architect(s) shall apply for F to designate an agent(s).
