The prosecution of this case is dismissed.
1. Around 16:52 on October 14, 2018, the Defendant sent a message that “C continues to sell and purchase an apartment site address, Kakao Stockholm Group or any murder, and, at the same time, did not know of three murder cases,” and caused the victim to take a fright by finding the victim as if he/she did assault.”
Accordingly, the defendant threatened the victim.
2. The facts charged in the instant case are those falling under Article 283(1) of the Criminal Act, and cannot be prosecuted against the express will of the victim under Article 283(3) of the Criminal Act.
However, since the prosecution of this case was submitted on April 14, 2020 to the effect that "the victim does not want the punishment against the defendant," the court below dismissed the prosecution of this case pursuant to Article 327 subparagraph 6 of the Criminal Procedure Act. It is so decided as per Disposition.
