A defendant shall be punished by imprisonment for not less than eight months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
"200 Highest 1636"
1. Around March 13, 2020, the Defendant committed a crime: (a) around 07:00 on March 13, 2020; (b) around 07:00 on the roads front of Macheon-si; and (c) on the roads front of Macheon-si where the victim C(59) drive, the Defendant was able to pay the charges.
However, even if the victim operates a taxi at the request of the defendant, the victim did not have the intent or ability to pay the taxi fee.
Accordingly, the Defendant: (a) by deceiving the victim as above; (b) caused the victim to operate the taxi to the 144 area by the her draft line; and (c) did not pay 49,000 won to the her draft line; and (d) acquired the pecuniary benefits equivalent to the same amount.
2. Around March 16, 2020, the Defendant committed the crime: (a) around 12:47 March 16, 2020, committed the crime: (b) around F on the roads located in Gyeonggi-si E; (c) on the roads located in Gyeonggi-si; (d) on the H personal taxi driven by the victim G (the age of 62), and (e) committed the crime as if he were to pay the fee.
However, even if the victim operates a taxi at the request of the defendant, the victim did not have the intent or ability to pay the taxi fee.
Accordingly, the Defendant: (a) by deceiving the victim as above; (b) caused the victim to operate on the first road in Macheon-si; and (c) caused the victim to pay the taxi fee of KRW 106,800,000, thereby acquiring the same pecuniary benefit.
3. On March 30, 2020, the Defendant ordered the Defendant to pay the amount of food and alcohol equivalent to KRW 43,000,00 in the market price of 50 grams, including the high season, etc., and the Defendant ordered the Defendant to pay the amount from the “L” operated by the Victim K (n, n, n, n, n, n.e., n., n., n. n. n. n. n. n. n. n., n. n. n. n.
However, even if the victim received food, there was no intention or ability to pay the price to the victim.
Accordingly, the Defendant, by deceiving the victim as above, received property equivalent to the market price of KRW 43,00 from the victim.
The defendant of "200 Highest 1801" shall be the defendant of March 2020.
