성폭력범죄의처벌등에관한특례법위반(13세미만미성년자강제추행)
A defendant shall be punished by imprisonment for not less than two years and six months.
However, the execution of the above punishment shall be suspended for a period of three years from the date this judgment becomes final and conclusive.
Punishment of the crime
1. 피고인은 2014. 7. 하순 16:00 경부터 17:00 경 사이에 포항시 북구 C에 있는 D 유치원 앞에서, 길을 지나던 피해자 E( 여, F 생, 당시 11세) 을 뒤따라가다가 피해자에게 “ 커피 살 돈 100원만 달라.” 고 말하면서 손으로 피해자의 오른손 손목을 잡고 계속하여 피해자의 오른쪽 어깨를 여러 차례 만지면서 “ 아이스크림 핥아먹는 게 좋아 빨아먹는 게 좋아 사 줄까 ”라고 말하였다.
Accordingly, the defendant forced the victim under 13 years of age to commit an indecent act.
2. On February 15, 2015, the Defendant: (a) around 15:00, in front of the G apartment house located in North Korea-gu G at the port, the Defendant: (b) placed the victim H (WW, I, the age of 11 at the time) who passed his/her seat in his/her hand; (c) held the victim’s hand in his/her hand; (d) held the victim’s hand; and (e) held the victim’s hand; and (e) held the victim’s hand, “IW, I, and I, the age of 11 at the time, I,” and (e)

Accordingly, the defendant forced the victim under 13 years of age to commit an indecent act.
3. 피고인은 2015. 3. 중순 15:00 경 포항시 북구 C에 있는 ‘J 초등학교’ 뒤편에 있는 산길에서, 문구점에 가 던 피해자 K( 여, L 생, 당시 12세 )를 뒤따라가다가 손으로 피해자의 오른쪽 손목을 붙잡고 끌어당기면서 “ 너 어디 사니 어디 학원 다니니 아이스크림 빠는 거 좋아해 아니면 핥는 거 좋아해 좋은 데 있는데 같이 안 갈래 야 동 좋아해 ”라고 말하였다.
Accordingly, the defendant forced the victim under 13 years of age to commit an indecent act.
4. On April 1, 2015, the Defendant: (a) at the “M” convenience store located in Northern-gu, Northern-si, Ma on April 18:30, 2015, the Defendant used the convenience store to put the victim H (n, I, I, and the age of 11 at that time) to the victim’s hand, thereby putting the victim’s hand; and (b) “Nran chips, I, I, and I, I, you will reduce the victim’s hand” on the hand of the victim.
Accordingly, the defendant is the victim under 13 years of age.
