However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

The Defendant is a singing practice room operator operating the Eunpyeong-gu Seoul Metropolitan Government “C” in Eunpyeong-gu.

No singing practice room business operator shall sell or provide alcoholic beverages.

Nevertheless, at around 01:00 on July 16, 2020, the Defendant sold and provided two customers, such as D, who are customers in the place of the instant singing practice, with four cans of 16,000 won in the market value, and per day, etc.

The reason for sentencing under Article 62-2 of the Social Service Order Criminal Act committed the instant crime even though the Defendant had been subject to 9 times or criminal punishment due to the violation of the Music Industry Promotion Act, such as a violation of the obligation of a singing practice room business operator, etc.

However, considering the favorable circumstances of the defendant, such as the fact that the defendant recognized the crime and reflects the wrong, the punishment as ordered shall be determined by comprehensively considering the defendant's age, sexual conduct, environment, motive, means and consequence of the crime, circumstances after the crime, etc., and the sentencing conditions specified in the records and arguments of this case, such as the circumstances after the crime.
