The prosecution of this case is dismissed.
1. Around November 22, 2014, the Defendant discovered that the victim D (at 55 years of age) sells fishing gear on the front side of Seongbuk-gu Seoul, Seongbuk-gu (hereinafter “Seoul”) around November 11, 2014, and, under the influence of alcohol, the Defendant committed assault against the victim, without any reason, by drinkinging the victim’s breath that “hingly, gingly, hinging, and hinginging public eggs,” following the breathing of the breath to the right side of drinking, blading the back head with his hand, leaving the back head over the floor.”
2. Determination
(a) Crimes of non-compliance with an intention (Article 260 (3) of the Criminal Act);
(b) The victim is not subject to punishment;
(c) Judgment dismissing public prosecution (Article 327 subparagraph 6 of the Criminal Procedure Act);
