A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
On November 15, 2011, the Defendant received a summary order of KRW 2.5 million from the Cheongju District Court to a fine for a violation of the Road Traffic Act, and a summary order of KRW 3.5 million from the same court on January 12, 2016 to a fine for a violation of the Road Traffic Act.
1. The Defendant is a person engaging in driving service of a vehicle with a hurburg from a vehicle B.
Around 00:00 on April 5, 2020, the Defendant driven the above vehicle while under the influence of alcohol of 0.162% with a blood alcohol concentration of 0.162%, and led the roads in front of the “D” office in Seo-gu, Seo-gu, Seo-gu, Seo-gu, Seo-gu, Seo-gu, to the unclaimed Children Park in the front of the E elementary school.
In such cases, there was a duty of care to prevent accidents by accurately manipulating the steering and brakes to those engaged in driving of motor vehicles.
Nevertheless, the Defendant neglected to do so and neglected to proceed on the left-hand side of the running direction of the said vehicle, and received the part of the Victim F’s GPD125A, which was parked on the left-hand side of the said vehicle.
Ultimately, the Defendant, by occupational negligence, destroyed the above 480,000 won of the repair cost, and immediately stopped, and went away from the site without taking necessary measures, such as providing personal information to the victim.

As a result, the Defendant violated the “Prohibition of Driving under the influence of alcohol” at least twice.
