A. On July 29, 2013, the Defendant concluded a contract to establish a non-exclusive license to use a trademark (hereinafter “instant contract”) with Lohovapha Korea Co., Ltd. (hereinafter “PS”) and agreed to pay an amount equivalent to 4.0% of the monthly sales (excluding value-added tax) to the non-party company as the price for the exclusive use of the non-party company’s trademark right and selling the designated goods to the non-party company as the end of the following month.

B. On February 13, 2015, Nonparty Company transferred all claims against the Defendant arising under the instant contract to the Plaintiff, and notified the Defendant of the assignment of claims on the same day.

Accordingly, on February 17, 2015, the defendant notified the assignment of claims by a certificate with a fixed date without reservation.

C. The sales amount for which the Defendant sold the designated goods by exclusively using the trademark rights of the non-party company, and the amount of trademark fees to be paid under the instant contract are as follows.
