1. On January 21, 2015, the National Labor Relations Commission rendered unfair remedy between the Plaintiff, the Intervenor C, and D, No. 2014, 1175.

Reasons

1. Details of the decision on retrial;

A. The Plaintiff is a corporation that ordinarily employs 29,000 workers and engages in railroad transportation, etc.

On February 19, 2001, the Intervenor A (hereinafter referred to as the “ Intervenor A”) entered the office of the transportation staff of the steel station, and served as a traffic controller from March 4, 201 to the control department of the Railroad Traffic Control Center.

The Intervenor B (hereinafter referred to as the “ Intervenor B”) joined the Plaintiff corporation on August 30, 1993, and served as the Daejeon Agency’s Office of Business and Staff from August 1, 2007.

On March 3, 1989, the Intervenor C (hereinafter referred to as the “ Intervenor C”) was employed as the service personnel of the Busan Regional Railroad Office, and served as the E calendar head and a local officer from August 8, 2011.

On April 20, 1982, the Intervenor D (hereinafter referred to as the “ Intervenor D”) joined the Busan Regional Railroad Service and served as a safety manager at the Daegu Headquarters Safety and Environment Office from July 14, 2006 through the vice head and station commander, etc., and served as a substitute crew member from July 29, 2013 in accordance with the “the strike for refusal of holiday work” of the Korea Railroad Trade Union.

B. The Intervenor, an engineer, was driving the G-U.S. M. G-U. G-U. M. G-U. G-U. G-U. G-U. G-U. G-U. M. (hereinafter “the instant Rose of Sharon”) and arriving in the E-U.S. No. 12 at 7:00 a.m.

On the other hand, Seoul KSE (hereinafter “instant upper speed train”) started from H to 10:0 am 7:00 a.m., and the instant upper speed train is a train operated without stopping in the E stations.

At the time, the Intervenor A, who served as a traffic controller at the Railroad Traffic Control Center, was informed of the temporary driving order in order to stop the instant Rose of Sharon train in the E Station and pass it first to the Intervenor C who was working as a local officer for the E Station.

The Intervenor C is to pass first to the high speed train of this case.
