1. The Defendant shall calculate the amount of KRW 35 million to the Plaintiff at the rate of 15% per annum from October 5, 2016 to the date of full payment.
Reasons
1. Indication of Claim: On September 10, 2012, the Plaintiff lent KRW 50 million to the Defendant at an interest rate of 2% per month and on February 15, 2016.
Accordingly, the Plaintiff seeks to pay 35 million won from the above loans to the Defendant and to pay damages for delay calculated at the rate of 15% per annum under the Act on Special Cases concerning Expedition, etc. of Legal Proceedings from the day after the original copy of payment order is served to the day of complete payment.
2. Judgment without holding any pleadings: Articles 208(3)1 and 257 of the Civil Procedure Act.
