The prosecutor's appeal is dismissed.
Reasons
The prosecutor has sufficient proof of crime based on the victim's statement, etc. on the grounds of appeal. Thus, the court below erred in misconception of facts.
The argument is asserted.
However, in light of the various circumstances duly admitted by the lower court, even if the prosecutor’s assertion on grounds of appeal is considered, the evidence alone submitted to the extent that there is no reasonable doubt as to the facts charged.
The judgment below which acquitted the defendant on the ground that it is insufficient to see that there was an error of mistake as alleged by the prosecutor.

The prosecutor's appeal is dismissed for lack of reason.
