The prosecutor's appeal is dismissed.
1. The summary of the grounds for appeal was recognized by the Defendant, and the Defendant’s act was in need of measures to ensure safe and smooth flow of traffic.
2. The court below stated the reasons in detail, and found the defendant not guilty on the grounds that the evidence submitted by the prosecutor alone is insufficient to recognize that the defendant was aware of an accident, and it is difficult to deem that any traffic danger or obstacle has occurred at the time. In light of the reasoning of the judgment below compared with the records, the judgment of the court below is just and it is not erroneous in the misapprehension of facts, which affected the conclusion of the judgment.
3. Therefore, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the appeal is without merit. It is so decided as per Disposition.
