Reasons

The Plaintiff, as a redevelopment and maintenance project partnership under the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter “Urban Improvement Act”), sought to transfer real estate listed in the attached list owned by the Defendant included in the rearrangement zone pursuant to Article 49(6) of the Urban Improvement Act, and the Defendant asserts that the right to use and benefit is not restricted in the case of the right holder whose compensation is not completed pursuant to the proviso to Article 49(6) of the Urban Improvement Act.
