The defendant's appeal is dismissed.
According to the records, the court rendered a judgment imposing a fine of KRW 2,00,000 on the thief case on November 21, 2012, when the defendant was absent, pursuant to Article 277 subparagraph 4 of the Criminal Procedure Act, with respect to the thief case on which the defendant was sentenced to a fine of KRW 2,00,00,00. The defendant did not submit a petition of appeal within the period of appeal, and the defendant submitted a petition of appeal on December 17, 2012 after the said period expires.
Therefore, since the appeal of this case is clearly filed after the expiration of the right to appeal, it is dismissed pursuant to Article 360(1) of the Criminal Procedure Act, and it is so decided as per Disposition.
