Reasons

Punishment of the crime

1. Under the premise, Defendant A was a person who served as the president of the Foundation C from November 26, 2016 to March 27, 2018, and Defendant B was in exclusive charge of duties concerning the employment of employees, such as the formulation, progress, results reporting, and final decision on successful applicants, as the head of the management support office of the Foundation C. D (Suspension of Prosecution on the same day) was a person in charge of personnel affairs of C.

According to the 2017 new employee recruitment plan established in accordance with C personnel regulations, C, a foundation, was selected through the first, second, and third and third interview and was required to report six final successful applicants to C, the representative of C, through open competition.

Accordingly, according to the first recruitment plan, Defendant A decided to employ five employees through an open competitive recruitment procedure. 2. As a result of the written examination conducted after the fact of crime, the above G's written examination scores are above 8, Defendant A, while meeting together with Defendant B and D, can receive an interview scores from the interview members and pass G.
