Punishment of the crime
Defendant
A is a personal information manager who works as F from the branch office of the National Health Insurance Corporation and has been in charge of issuing health insurance certificates, etc., and Defendant B is a person operating G.
A personal information manager shall not provide a third party with personal information without obtaining the consent of the subject of information, except in extenuating circumstances prescribed by statutes, and shall notify the subject of information of the details prescribed by statutes, such as the recipient, purpose of use, period of holding, etc., and the consent shall be given in accordance with the methods prescribed by statutes, such as obtaining written consent signed
In addition, no one shall be provided with personal information from a personal information manager with knowledge of the situation without the consent of the owner of information.
1. Defendant A
A. A. Around January 2012, the Defendant received, by facsimile, a list of the applicants for issuance of health insurance certificates, such as H, from B, upon the applicant’s request that “in order to file an application, the Defendant intended to operate the massage service program for the elderly, etc., from creative viewing, and the applicant’s health insurance certificate is required for the elderly to be issued.”
On January 9, 2012, the Defendant provided B with personal information of 109 persons without the consent of the subject of information, as described in attached Table 1, from around the time to January 23, 2013, by re-issuance of the health insurance card using the aforementioned computer, without obtaining the consent of the E branch office of the National Health Insurance Corporation I located in Sa city, by using the said Corporation’s E branch office, and then transmitting it to B by copying the pages of the health insurance card title, the insured, and the personal information of his/her family members.
