However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

On June 2013, the Defendant: (a) heard the victim C (n, 58 years of age) who became aware of in the early 2013 sports dancing teaching school; (b) heard the victim’s speech that the victim was able to live alone; and (c) thought that the victim was an attorney-at-law and prosecutor, and the victim was the victim, and had access to the victim; and (d) thought that the victim was not in the nature of the victim, the Defendant was able to keep the victim out of money by deceiving the victim, and threatening the victim.

1. Attempted crimes;

가. 피고인은 2013. 8. 7. 15:20경 성남시 중원구 D에 있는 E고시텔 73호실 피고인의 주거지에서 피해자에게 전화하여 “니가 내 좆 빨아준 것 동영상 다 찍어 놨는데, 성남시에 너 아는 지인들에게 퍼트리겠다. 아들, 며느리와 동생들에게 알리겠다. 내 좆 빨은 값 500만 원을 달라.”라고 말하여 피해자로 하여금 겁을 먹게 하고 피해자로부터 500만 원을 갈취하려 하였으나 피해자가 이에 응하지 않아 미수에 그쳤다.

나. 피고인은 2013. 8. 9. 10:30경 성남시 수정구 F 부근의 피고인의 차량 안에서 피고인이 그 전에 피해자와 유사성행위를 할 때 피해자 몰래 피해자의 모습을 휴대폰으로 찍어 놓은 동영상을 피해자에게 보여주며 “아들, 며느리 전화번호 다 따 놨다. 찾아 가서 1,000만 원을 달라고 하겠다. 동생들에게 알리겠다.”라고 말하면서 피해자에게 수협 계좌번호를 적어주어 피해자로 하여금 겁을 먹게 하고 피해자로부터 1,000만 원을 갈취하려 하였으나 피해자가 이에 응하지 않아 미수에 그쳤다.

C. On August 11, 2013, at around 06:00, the Defendant continued to gather the first races and open the entrance of the victim before Sungnam-gu G, Sungnam-gu, 907 Dong 606 (H building), which is the victim’s residence, and the victim fageed by opening the door.
