Reasons

1. Basic facts

A. On October 4, 199, the Defendant was the implementer of the Road Packing project between G on the F of the Notification of the Sungsung-gun, G (hereinafter “instant road project”). The project was an urban planning project, which is a project for which the total length of 3.34 km from H to I of the ethic City of ethic City is confirmed and packaged by December 30, 2004.

In accordance with the Act on Special Cases Concerning the Acquisition of Land for Public Use and the Compensation for Loss in order to acquire the site for the road project of this case, the Defendant acquired the land indicated below the table owned by Plaintiff A and Nonparty J (hereinafter “each land of this case”) through consultation, completed the registration of ownership transfer based on consultation on the land for public use in the future of the Defendant, and the detailed details thereof are as listed below:

Since then, on April 25, 2001, the Minister of Construction and Transportation designated Q and P as a zone subject to housing site development in the chemical zone on the O of the Ministry of Construction and Transportation on Apr. 25, 2001. On Dec. 14, 2001, the Minister of Construction and Transportation, upon notification of the Ministry of Construction and Transportation, officially announced the alteration of the designation of a zone subject to housing site development in the chemical zone and the development plan for housing sites (the project implementer succeeded to the rights and obligations after the establishment of the Korea Land and Housing Corporation on Oct. 1, 2009) as a zone subject to housing site development in the chemical zone, and approved the alteration of the housing site development plan and the implementation plan for the housing site development project in the chemical zone as a zone subject to the notification of the Ministry of Construction and Transportation on Dec. 14, 2001 (hereinafter “the alteration of the housing site development plan”).

Each land of this case is included in the housing site development area, and the road project of this case.
