At around 06:26 on April 24, 2019, the Defendant: (a) discovered that the victim D was locked by leaving the key to the object on the floor in Suwon-si, Suwon-si, Suwon-si; (b) used the key to the victim, thereby cutting down Samsung Gallon S7 mobile phones and KRW 100,000 in cash worth of KRW 1,00,000 in the market value of the victim’s possession in the victim’s right box.

At around 06:31 on April 24, 2019, the Defendant acquired pecuniary benefits equivalent to the same amount by using the victim’s mobile phone in Samsung Ggal ju City Co., Ltd., as described in the foregoing paragraph 1, using the victim’s mobile phone in Samsung Gal ju City S7 mobile phones, which is the victim’s D, and by using the victim’s mobile phone small payment method, in purchasing cultural products equivalent to KRW 100,000, the Defendant acquired monetary benefits equivalent to the same amount by imposing the victim’s mobile phone usage fee. From that point of time, the Defendant acquired pecuniary benefits by using the victim’s mobile phone from around 09:21 on 10 occasions in total using the victim’s mobile phone from around 09:21 on the same day.

Accordingly, the defendant acquired property benefits by inputting information without authority into the data processing device such as computer, etc.

around April 24, 2019, the Defendant posted a letter stating that “I sell cultural product certificates” after accessing the PC room located in Suwon-si, Gyeonggi-do, by means of a mobile phone, from the PC room located in Suwon-si, and that I would send the PIN number of cultural product rights to the victim E who reported and contacted with the “I would send money to the account.”

However, even if the defendant receives money from the victim, he did not have the intention or ability to inform the PIN number of cultural product right as the promise.
