1. The Defendant shall pay to the Plaintiff KRW 38,613,789 and interest rate of KRW 20% per annum from September 28, 2017 to the day of complete payment.
Comprehensively taking account of the purport of Gap evidence 1 and Eul evidence 1, the plaintiff provided labor under employment of the defendant company from February 1, 2008 to September 13, 2017 (2,10,110 won for November 1, 2016; 1,924,040 won for December 1, 2017; 2,683,710 won for February 2, 2017; 30 won for March 1, 206, 30 won for April 1, 203; 1,943, 240 won for April 2, 207; 1,940, 840, 70 won for May 1, 207; 308, 300 won for retirement allowances; 308, 307, 3088, 86 won for May 28, 208, 3088
According to the above facts, the defendant is obligated to pay to the plaintiff the total amount of 38,613,789 won and damages for delay calculated at the rate of 20% per annum under Article 37(1) of the Labor Standards Act and Article 17 of the Enforcement Decree of the same Act from September 28, 2017 to the date of full payment, which is the 14th day after the plaintiff's retirement date.
Thus, the plaintiff's claim of this case is justified, and this is accepted.
