A. The plaintiff A is a student who was enrolled in the third grade of the M Middle School in Permitted-si, and the defendant D, the defendant G, and the defendant J are students who were enrolled in the second grade of the same school.

나. 원고 A은 2017. 3. 7.경 하교길 버스에서 큰소리로 얘기하고 노래하던 2학년 학생들인 피고 D, 피고 G, 피고 J(이하 피고 D, 피고 G, 피고 J을 함께 지칭하는 경우 ‘피고 학생들’이라고 한다)을 보고 손가락을 입에 대고 "쉿'이라고 말하며 조용히 하라는 제스처를 취하였고, 이에 기분이 상한 피고 학생들은 "겁나 어이 없어, 찐따 같아"라고 말하였다.

C. Around March 29, 2017, Defendant students discovered Plaintiff A from a school bus in the school meal room or corridor, etc. In particular, around March 29, 2017, Defendant students threatened Defendant G with violence, such as discovering Plaintiff A, following Plaintiff A, and continuing to engage in severe humiliation and insulting remarks, and brupting a bank, and by using Defendant G’s pet dog.

Defendant students continued to use violence, such as preventing Plaintiff A from driving an apartment elevator in which Defendant students’ desire and threatening to play, continuously taking a bath, putting the shoulder, or exposing the shoulder. D.

Due to the aforementioned harmful act by Defendant students, Plaintiff A suffered from “incompetence accompanied by an incompetence, depression, emotional instability, etc.” and “incompetuous stress disorder” due to the harmful act by Defendant students, etc., and for the purpose of the treatment, Plaintiff A received a mental therapy at the Native Hospital located in Suwon-si from March 31, 2017 to January 8, 2019, or provided counseling treatment at the O Center located in Suwon-si, Suwon-si.
