On April 5, 2013, at a place where the place is unknown, the Defendant stated that “the victim B, who is the excavated pilot, will take place 6.4 million won from April 5, 2013 to May 23, 2013 so that landscaping works may be performed at a farm located in the Gyeongwon, such as the Sinsan City City farm,” and that “the victim would complete tree transport and extraction works.”

However, even if the above landscaping work is completed, the defendant did not have the intent or ability to reduce the construction cost to the victim because there was no particular property.

Accordingly, the defendant, by deceiving the victim, acquired property benefits equivalent to 6.4 million won.
