A shall be punished by imprisonment for eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Defendant A, under his own name, concluded a check contract with the Nonghyup Bank on August 3, 2012, and with a branch office of the Korea Standards Bank, on January 15, 2013, with each of the following points.

A around January 8, 2013, around Gwangju-si: (a) MM office operated by the Defendant in Gwangju-si, a check number “D”, (b) “D”, “20,000,000 won”, and (b) the date of issuance “the date of issuance, April 8, 2013”; (c) issued one copy of the per unit number of the Bank in Korea under the name of the Defendant; and (d) from that time until March 25, 2013, as shown in attached Table 1, [excluding Nos. 1, 2, 4, 8 ( check No. D, E, F, G)], total face value of KRW 151,535,00 per unit amount, issued six copies of the check number per each check holder’s proposal of payment, but did not receive deposits or suspension of transactions within each check holder.

Defendant A, under his own name, concluded a check contract with the Nonghyup Bank on August 3, 2012, and with a branch office of the Korea Standards Bank, on January 15, 2013, with each of the said branches.

A around January 8, 2013, around Gwangju-si, issued one check number H, issuance date “H”, “5,00,000 won” in the (ju) MM office operated by the Defendant in Gwangju-si, as well as one check number e.g., No. 2 (excluding check number H, I, J, and K) from that time until April 20, 2013) as stated in the attached Table 2 [Attachment No. 1,3,5,7 ( check number H, I, J, and K)], such as the check number 60,00,00 won per share e.g., the check number 60,000 won per share, and each check holder proposed to pay within the time limit for payment, but did not receive as a suspension of transaction.

Defendant A is the representative director in the name of (State)M, and N is the actual operator of (State)M.

Defendant

A under its own name entered into a check contract with the Nonghyup Bank on August 3, 2012, and with a branch of the Korea Standards Dold World Bank on January 15, 2013, and N has the corporate name plate, representative director's seal impression, etc.
