1. The Defendant shall pay to the Intervenor succeeding to the Plaintiff KRW 94,768,050 and KRW 91,801,307 among them. The Defendant shall pay full payment from May 18, 2017.
Reasons
1. On June 2, 2017, the Plaintiff’s Intervenor succeeded to the indication of the claim, transferred from the Plaintiff the claim as indicated in the attached Form.
2. Determination
A. Judgment without holding a claim by the Plaintiff-Succession Intervenor (Articles 208(3)1 and 257(1) of the Civil Procedure Act)
B. The plaintiff filed a claim against the defendant, but the plaintiff transferred the above claim against the defendant to the plaintiff succeeding intervenor during the lawsuit of this case. Thus, the plaintiff's claim is dismissed as it is without merit.
