1. The defendant shall be punished by imprisonment with prison labor for ten months;
2. Provided, That the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive;
Punishment of the crime
On April 15, 2006, the Defendant got a driver’s license and a passport in the name of son and friendly B, and attempted to flee abroad. On February 15, 2008, the Defendant escaped to Austria using B’s passport in the name of son and friendly B.
The Defendant was arrested and detained at the Incheon Public Port around March 14, 2012 while staying in Austria with a view to escape from criminal punishment based on the facts of the instant crime as well as the said fraud.
On October 25, 2012, the Defendant was sentenced to two years of imprisonment and three years of suspended execution at the Busan District Court. On November 2, 2012, the above judgment was finalized on November 2, 2012.
1. Around October 15, 2007, the Defendant filed an application for re-issuance of the driver’s license under B while misrepresenting himself as B and submitting the Defendant’s photograph.
Around that time, the defendant received one copy of the driver's license under the name of the Commissioner of the Busan Local Police Agency, in which the personal information of B is stated from any employee working at the above licensing examination site and the photograph of
Around October 30, 2007, the Defendant continued to submit a passport-related civil petition office in Gwangjin-gu, Seoul Special Metropolitan City, the first floor underground of the Gu, Gwangjin-gu, Seoul Special Metropolitan City, for the purpose of verifying the identity of the driver of the motor vehicle who unlawfully received the above unlawfully as stated in the B’s application for a passport issuance.
Accordingly, the defendant made a false report to a public official, and made him enter false facts in his license, and exercised a false license.
2. The defendant's non-entry in the passport and the non-entry and passport use events are the defendant's photograph as stated in paragraph (1) at the Gwangjin-gu Office Passport civil service center as stated in paragraph (1) on October 30, 207, while presenting the B's personal information and presenting the driver's license illegally issued as above for the purpose of identification.
