The plaintiff's claim is dismissed.
Litigation costs shall be borne by the plaintiff.
1. The Plaintiff asserts that the Defendant lent KRW 10 million on September 15, 2015, and KRW 39,900,000 on October 2016, respectively.
Comprehensively taking account of the overall purport of the pleadings in evidence Nos. 1 and 2, the fact that the Plaintiff remitted total of KRW 10,000,000 to the Defendant on September 15, 2015, and that the Plaintiff remitted total of KRW 39,90,000 to the Defendant through the Plaintiff’s bank account in the Plaintiff’s name around October 2016 is recognized.
However, the above evidence alone is insufficient to recognize that each remittance amount was a loan to the defendant, and there is no other evidence to acknowledge it.
Therefore, the plaintiff's assertion is without merit.
2. In conclusion, the plaintiff's claim is dismissed as it is without merit. It is so decided as per Disposition.
