A. On April 20, 2014, the Plaintiff entered into a contract with Defendant New Zealand Construction Co., Ltd. (hereinafter “instant construction site”) to supply ready-mixeds to the factory construction site of Defendant Green Food Co., Ltd. (hereinafter “instant contract”). From May 2, 2014 to October 23, 2014, the Plaintiff supplied ready-mixeds equivalent to KRW 95,61,060 in total. The Defendant New Zealand Construction Co., Ltd. did not pay KRW 60 million in total with the payment of KRW 35,661,00,000,000 in remainder, and paid KRW 35,661,060 in remainder.

2. The Plaintiff entered into a contract to supply ready-mixed to the factory construction site of Defendant Green Food Co., Ltd. (hereinafter “instant contract”) on April 20, 2014, taking into account the following facts: (a) there is no dispute over the determination of Defendant Green Food Co., Ltd.; and (b) the entire purport of the pleadings in the written evidence Nos. 1 and 2, the Plaintiff entered into a contract with Defendant Green Food Co., Ltd. on April 20, 2014 to supply ready-mixed at the factory construction site of Defendant Green Food Co., Ltd. (hereinafter “instant contract”); and (c) Defendant Green Food Co., Ltd. entered into an agreement with the Plaintiff to pay the said ready-mixed price jointly with Defendant New High Integrated Construction Co., Ltd. From May 2, 2014 to October 23, 2014 under the instant contract, the Plaintiff supplied 95,661,060 won in total to Defendant New Zealand Construction Co., Ltd., and KRW 35,661,060 in total from Defendant New Zealand Construction Co., Ltd. on September 10, 2014, KRW 20,000,000 on September 22, 2014; KRW 30,000,000 on October 31, 2014; and KRW 60,000,000 in total, and KRW 60,61,060 in remainder.
