1. The defendant shall not exceed KRW 27,256,963 and KRW 26,227,553 among them to the plaintiff within the scope of the property inherited from the deceased B.

The facts that the Plaintiff asserted as the cause of the instant claim, and the facts that the Defendant, after his death, was subject to the Seoul Family Court Decision 2009Ra4802, inherited qualification adjudication by inheritance under the deceased B, may be acknowledged by taking account of the overall purport of the pleadings in each of the statements in Gap evidence No. 1 and No. 3.

According to the above facts of recognition, the Defendant, as the heir of the deceased B, is obligated to pay the Plaintiff the amount equivalent to the inheritance share out of the remainder of the debt, such as the reimbursement amount, within the scope of inherited property from the deceased B.
Therefore, the defendant is obligated to pay to the plaintiff 27,256,963 won in total and 26,227,53 won in total and 18% per annum from August 24, 2001 to May 31, 2005, 15% per annum from June 1, 2005 to October 27, 2006, and 20% per annum from the next day to the day of full payment.
