1. The Defendants shall jointly and severally pay to the Plaintiff KRW 42,00,000 and the interest rate thereon from September 21, 2017 to the date of full payment.
Reasons
1. Until March 2017, the Plaintiff: (a) supplied Kimchi, etc. to Nonparty Gelim Cooperatives on credit; and (b) the outstanding credit amount was KRW 51,387,000.
On April 25, 2017, the Defendants promised to pay to the Plaintiff the outstanding credit amount of KRW 52 million up to May 10, 2017, but thereafter paid KRW 10 million.
Therefore, the defendants are jointly and severally liable to pay to the plaintiff 42 million won and damages for delay.
2. Judgment based on the deemed confession based on recognition (Article 208 (3) 2 of the Civil Procedure Act).
