The prosecution of this case is dismissed.
Reasons
1. Around 17:00 on March 16, 2019, the Defendant assaulted the victim’s left shoulder with a hand saw while she was wraped with the victim D within the Daegu Suwon-gu Building C.
2. Determination
(a) Provisions of applicable provisions to charges: Article 260 (1) of the Criminal Act;
(b) Crimes of non-compliance with will: Article 260 (3) of the Criminal Act.
(c) Non-compliance with punishment: A written agreement on November 2, 2020 and an application for non-compliance with punishment;
(d) Judgment dismissing public prosecution: Article 327 subparagraph 6 of the Criminal Procedure Act;
