A defendant shall be punished by imprisonment for not less than one year and six months.
1,350,000 won shall be additionally collected from the defendant.
Punishment of the crime
On March 24, 2010, the Defendant was sentenced to one year of imprisonment for a violation of the Act on the Control of Narcotics, Etc. at the Suwon District Court on March 24, 201 and completed the execution of the sentence in the Busan Correctional Institution on January 10, 201.
The defendant is not a person handling narcotics.
1. At around 15:00 on April 28, 201, the Defendant issued and received approximately 0.15 g of psychotropic drugs-related Mesphere (one penphone; hereinafter referred to as “manspherephone”) to D at the visitors room near Seocheon-gu, Seocheon-si C Station.
2. On May 6, 201, the Defendant transferred KRW 400,000 to the new bank account (Account Number E) in the name of the Defendant, along with D’s request to request writingphones from D, and around that time, delivered KRW 400,000 to F, and received approximately 0.25 g of the penphones. On May 6, 2011, the Defendant delivered approximately 0.25 g of the penphones to D within the NAS car operated by D, which was stopped in the densely concentrated area near the Seocheon-gu, Seocheon-gu G, Seocheon-gu G, 201.
Accordingly, the defendant assisted the trade of philophones between D and F.
3. On May 11, 201, the Defendant transferred KRW 400,000 to the new bank account (Account Number E) with the Defendant’s name, upon request for scoponing from D, and around that time, delivered KRW 400,000 to F and received approximately 0.4 g of oponon, and around May 11, 201, delivered approximately 0.4 g of oponon to D within the NA car operated by D, which was stopped on the street near the Hank-gun-gun, Chungcheongnam-gun, Hak-gun, Hak-gun, the Defendant issued approximately 0.4 g of oponon to D.
Accordingly, the defendant assisted the trade of philophones between D and F.
4. On May 14, 201, the Defendant received 0.4 g of the philopon from D and received approximately KRW 0.4 g of the philopon from F around that time. On May 14, 2011, the Defendant issued approximately 0.4 g of the philopon to D in front of the Hamopon budget I et al. on May 14, 201, and delivered 40,000 won in cash from D to F.
