2. However, we cannot accept the judgment of the court below for the following reasons.

First, according to the reasoning of the judgment below, the court below determined that the design was not similar because the two designs had considerable differences in the overall aesthetic sense without comparing the elements such as the fact that the external appearance of the main body and the external appearance of the main body are almost the same as that of the main body when comparing the registered design of this case with the design of this case.
