피고인은 항공기 관련 부품소재 등을 납품하는 주식회사 “C”에서 관리직원으로 근무하는 자로서, 2013. 4.경 한국항공우주산업 주식회사에 납품하기로 한 항공기 정비기구용 “어댑터 토크 렌치”에 사용되는 소재(STS304)와 관련하여, 납품예정일인 2013. 5. 1.경까지 공인기관의 시험결과서를 국방기술품질원에 제출하기가 어려워지자 공인기관 시험을 통과한 것처럼 시험결과서를 위조하여 국방기술품질원에 제출하기로 마음먹었다.

피고인은 2013. 4. 29.경 대전 유성구 D 2층에 있는 피고인이 근무하는 주식회사 “C” 사무실에서, 그 곳에 있는 컴퓨터에 보관 중이던『한밭대학교 공동실험실습관장』명의의 시험결과서 파일에 컴퓨터를 사용하여 ‘의뢰처’ 란에 ‘(주)C’, ‘접수일’ 란에 ‘2013년 4월 26일’, ‘주소’ 란에 ‘대전 유성구 D건물 2층’, '시료명‘ 란에 ’어댑터, 토크렌치용‘, ‘시험기간’ 란에 ‘2013년 4월 26일’, ‘용도’ 란에 ‘품질관리용’, ‘시험항목’ 란에 ‘인장강도’, ‘단위’ 란에 ‘N/㎟', '시험결과‘ 란에 ’520‘, 시험방법(적용규격)‘ 란에 ’KS B 0801 : 2007',‘날짜’ 란에 ‘2013년 4월 29일'이라고 각 입력한 후 한밭대학교 공동실험실습관장의 도장인 날인된 상태로 출력되도록 하였다.
