The prosecutor's appeal is dismissed.
1. According to the evidence submitted by the prosecutor, such as the statement of the persons involved in the summary of the grounds for appeal and the details of payment of the check withdrawn, the court below found that the defendant embezzled the membership fees of the Cmiddle School President Steering Committee (hereinafter “Steering Committee”) for personal purposes, but the court below acquitted the defendant. Thus, the court below erred by misapprehending the legal principles on the facts.
2. The judgment of the court below was duly adopted and examined by the court below and, in particular, Ma, who had been responsible for the general affairs of the Steering Committee from August 2013 to August 2014, stated that "the authority of the Steering Committee to actually execute the membership fees was the defendant, who was under the supervision of the Steering Committee, and could not execute the membership fees without the defendant's instruction."
