All appeals filed by the prosecutor against the Defendants are dismissed.
1. The summary of the grounds for appeal falls under the case where Defendant A received the entrustment of quality inspection pursuant to Article 41(2) of the Food Water Management Act, and the case where the Defendants received the entrustment of quality inspection. Therefore, the case where the Defendants conspired to issue a false quality inspection report with respect to such inspection under Article 58 subparag. 7-3 of the aforesaid Act constitutes the case where the Defendants intentionally issued a false quality inspection report while conducting the inspection under this Act.
Nevertheless, the court below, as a reference prosecutor, rendered a judgment of innocence on the ground that it was not a prosecutor under the above law. The court below erred in the misapprehension of legal principles.
2. Defendant A, from around July 2008, worked as the head of the G sub-branch of the Central Biomedical Institute G G sub-branch of the Namyang-si, who is an operator of the above G sub-branch. Defendant A is an employee of the above G sub-branch. Defendant B, as the head of the I team of the (ju) White-gun, Gyeonggi-gun, Y-gun, Y-do, 589, is an employee in charge of water quality inspection under the Water Management Act, who manages the water quality inspection of spring water as an employee in charge of water quality inspection under the Water Quality Management Act, who manages the water quality inspection of spring water as an employee in charge of water quality inspection of 60,000,000 if the raw water of spring water is produced through physical treatment of raw water in the case of water.
Defendant
A around December 4, 2015, upon request by a person under the Food Water Management Act for the raw water and the number of products of spring water from the above white beverage, the number of products produced in the white beverage that he/she sold in the city is unable to visit the white beverage due to personal circumstances.
