A defendant shall be punished by imprisonment with prison labor for up to six months.

Punishment of the crime

2. No person who violates the Passport Act shall transfer a passport to another person for the purpose of allowing him/her to use it;
Nevertheless, on March 2017, the Defendant issued a passport under the name of the Defendant to B for the purpose of allowing B to depart from the Republic of Korea using a passport under the name of the Defendant.
Accordingly, the defendant transferred a passport to another person for the purpose of using it.
3. Any national who intends to depart from the Republic of Korea outside the Republic of Korea of an unlawful passport or a violation of the Immigration Control Act shall undergo a departure inspection conducted by an immigration control official at the entry or departure port with a valid passport;
Nevertheless, the Defendant transferred to B a passport in the name of the Defendant, which was issued unlawfully as set forth in paragraphs 1 and 2, according to the above mother, and B.
