1. The extent of the property inherited from the deceased C shall not exceed the extent of the property:
(a) Defendant A shall be 75,090,078 won and this shall apply.
Comprehensively taking account of the overall purport of arguments in Gap evidence Nos. 1 through 4 and Eul evidence Nos. 1 (including branch numbers), the facts constituting the cause of the claim and C died on Jan. 29, 2017, and his spouse A, Defendant B, and the heir were the heir. The Defendants filed a report on the limited acceptance of inheritance with the Ulsan Family Court 2017Ra1381 on Dec. 26, 2017, and received the said report on March 20, 2018, respectively. Thus, even if the report is accepted and lawful, the inheritee’s obligation is entirely inherited to the heir according to the statutory share of inheritance. However, it is limited to the scope of inherited property only to the extent of inherited property. Thus, the Plaintiff’s claim for compensation of this case is justified as it is so decided as per Disposition by the assent of all participating Justices.
