In fact, the relevant plaintiffs (formerly, Company E) are companies engaged in the business of manufacturing automobile parts, the business of manufacturing automobile fixed glass products, the business of manufacturing automobile straws, the business of manufacturing automobile straws, and the business of manufacturing straws products. Defendant B is the representative director of F Co., Ltd. (hereinafter referred to as “F”), Defendant C is a professional architectural structural engineer operating G, and Defendant D is an architect who operates H architect office.
On July 23, 2010, the Plaintiff entered into a construction contract and completed a factory construction contract (hereinafter “instant construction contract”) with F on the construction of a ground factory of 47,196.40 square meters (hereinafter “instant factory”) with Ulsan-gu, Ulsan-gu, Seoul-do (hereinafter “instant factory”). The F obtained approval for the use of a factory after completing the construction work on March 24, 201.
Defendant B was in charge of the preparation of structural design drawings, the primary structural calculation, and the construction of steel structures, and Defendant C was in charge of the structural safety of the factory structure design process as a professional architectural structural engineer, and Defendant D was in charge of the design and supervision of the construction as an architect.
On February 11, 2014, as a three-day heavy snow concentrated on the Ulsan Northernbuk-gu, a factory roof was accumulated on February 11, 2014, and collapsed without checking the weight of snow, and an accident was caused by six employees, such as workers K, etc. (hereinafter “instant accident”).
As a result of the relevant criminal case, the Ulsan District Court, March 30, 2017, "Defendant B", in the construction process, shall calculate the primary structure based on the quality of the steel structure to be used for the actual construction work so that the professional structural engineer can properly determine the safety of the factory structure, and shall provide the results and basic data to the professional structural engineer accurately, and shall construct the steel structure after recognizing the stability of the steel structure designed by the professional structural engineer.
