1. The defendant shall be the plaintiff.

A. C. 8,305 square meters above land in Namyang-si, Namyang-si, 130, 131, 132, 133, 153, 152, indicated in the attached Form No. 130, 1305 square meters.

Reasons

Facts of recognition

On December 26, 1987, the Plaintiff completed the registration of ownership transfer on May 10, 1968 with respect to C & 8,305 square meters (hereinafter “instant land”).

D The Plaintiff entered into an oral lease agreement with the Plaintiff with respect to 881 square meters of the instant land, and leased and used the said part of the said land. On January 1, 2014, the Plaintiff entered into a lease agreement with D around January 1, 2014, with the term of lease from January 1, 2014 to December 31, 2015, agreed to KRW 4,043,790 per annum (2,02,00 as of June 1, 200, KRW 2,021,790 as of October 2, 202).

이 사건 토지 지상에는 “① 별지 도면 표시 130, 131, 132, 133, 153, 152, 151, 150, 149, 148, 147, 146, 145, 144, 143, 134, 135, 136, 137, 138, 139, 140, 141, 142, 130의 각 점을 차례로 연결한 선내 ㉳ 부분 기와 조 및 블록 조 건물 168㎡, ② 별지 도면 표시 169, 170, 171, 172, 169를 순차로 연결한 선내 ㉵ 부분 창고 18.5㎡, ③ 별지 도면 표시 158, 159, 160, 161, 162, 163, 164, 165, 166, 167, 158의 각 점을 차례로 연결한 선내 ㉶ 부분 블록 조 건물 53.7㎡, ④ 별지 도면 표시 154, 155, 156, 157, 154의 각 점을 차례로 연결한 선내 ㉷ 부분 창고 건물 9.5㎡( 이하 위 4동의 건물을 모두 ’ 이 사건 건물‘ 이라 한다)’ 이 존재하고 있고, D은 이 사건 건물과 이 사건 건물의 부지 등으로 이 사건 토지 중 별지 도면 표시 104, 105, 106, 107, 108, 109, 110, 111, 112, 113, 114, 115, 116, 117, 118, 119, 120, 121, 122, 123, 124, 125, 126, 127, 128, 129, 104의 각 점을 차례로 연결한 선내 부분 857.7㎡( 이하 ‘ 이 사건 점유부분’ 이라 한다) 을 사용하여 왔다.

The Plaintiff filed a lawsuit against D on the ground that D was the owner of the instant building, claiming the removal of the instant building, the delivery of the occupied part of the instant building, and the payment of unpaid rent by December 31, 2017, on the ground that the said lease contract was terminated on the premise that D was the owner of the instant building. The Plaintiff filed a lawsuit against D on December 19, 2018.
