The prosecutor's appeal is dismissed.
1. The decision of the court below against the defendant on the summary of the grounds for appeal is unreasonable because it is too unfasible.
2. Reviewing all of the sentencing conditions stated in the pleadings of the instant case, including the Defendant’s age, sex, family environment, the background and result of the instant crime, and the subsequent circumstances, it is deemed unfair that the lower court’s punishment is too unfasible and unfair, and thus, the prosecutor’s assertion is groundless.
3. Accordingly, the Prosecutor’s appeal of this case is dismissed in accordance with Article 364(4) of the Criminal Procedure Act on the grounds that the appeal of this case is without merit. It is so decided as per Disposition.
