1. Facts of recognition;
A. On June 25, 2003, in order to implement the housing reconstruction project (hereinafter “instant project”), the Defendant is a housing reconstruction project partnership established with the authorization of establishment from the Namyang-si mayor on June 25, 2003, and the Plaintiff A is a member of the Defendant who owns the 132 square meters of land and multi-household housing (ownership right 44/123), and the Plaintiff B also owns the FF large scale 112 square meters located in the instant project area and the 112 square meters of land stores and houses, respectively.
B. On March 22, 2007, the Defendant obtained an authorization for the implementation of the project on the application for parcelling-out and the Defendant’s administrative disposition plan for the Defendant; on July 26, 2007, the period for application for parcelling-out was set from July 31, 2007 to August 30, 2007; and on August 29, 2007, the Plaintiff announced the extension of the period for application for parcelling-out as of August 29, 2007 to September 9, 2007; 2) the Plaintiff applied for parcelling-out to the Defendant on August 29, 2007, within the period for application for parcelling-out, and the Plaintiff B applied for parcelling-out to the Defendant on August 21, 2007, within the period for application for parcelling-out.
3) On November 23, 2007, the Defendant held an extraordinary general meeting and included the assessed value of the previous land and buildings in the project implementation area of 60,784 square meters, 45,962 square meters of housing units in lots, 188,907,306,783 won, the assessed value of the previous land and buildings for calculating the estimated proportional rate of 161,808,627,633 won, the total project cost of 261,131,171,40 won, total revenue of 418,085,190,000 won, and the estimated proportional rate of 97% [the total revenue of 418,085,190,000 won - the total project cost of 216,131,171,400 won) / the assessed value of the previous land and buildings 161,806,2731,207.
