Punishment of the crime

1. 강도상해 피고인은 2003. 9. 28. 04:00경 서울 구로구 C 소재 E편의점에서 종업원인 피해자 F(19세)가 계산대에 혼자 있는 것을 보고 피해자에게 “돈을 내놔라”고 말하면서 미리 준비한 위험한 물건인 각목(길이 약 60cm, 넓이 약 5～6cm)으로 피해자의 왼쪽 머리를 1회 힘껏 내리쳐 피해자를 반항하지 못하게 한 후 피해자로부터 금품을 강취하려 하였으나 피해자가 소리를 지르면서 반항하는 바람에 그 뜻을 이루지 못하여 미수에 그치고, 피해자에게 머리를 4바늘 꿰매는 정도의 치료 일수를 알 수 없는 두피열상 등을 가하였다.
