The defendant's appeal is dismissed.
1. The summary of the grounds for appeal (the factual errors) did not steals a coolant, as stated in the facts charged in the instant case.
However, since the court below found the defendant guilty of the facts charged of this case, the court below erred by mistake of facts.
2. The court below rejected the defendant's assertion in detail by pointing out the same argument as the reasons for appeal in this case. The court below's decision is just and it is not erroneous in the misapprehension of legal principles as to the facts of the defendant's assertion, which affected the conclusion of the judgment by misunderstanding the facts as alleged by the defendant.
Therefore, the defendant's above assertion on this is without merit.
3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the ground that it is without merit. It is so decided as per Disposition.
