1. The Plaintiff:

A. Defendant C and D indicated the attached Form 1 among the first floor of the F apartment underground of Yeongdeungpo-gu Seoul Metropolitan Government, Yeongdeungpo-gu, Seoul, as well as the attached Form 11, 2, 3, 4, 21.

Reasons

1. Basic facts

A. The Yeongdeungpo-gu Seoul Metropolitan Government F apartment (hereinafter “instant building”) is an aggregate building of the 4th underground floor and the 16th ground floor, which is defined in the Act on the Ownership and Management of Aggregate Buildings, composed of sales facilities and neighborhood living facilities, etc. from the 1st to the 3rd ground, and apartment from the 4th to the 16th ground.

B. The Plaintiff is the sectional owners of 122 rooms, including subparagraph 2 of the first floor of the instant building. Defendant B and E are sectional owners who own 1/2 shares of each of 61 units, including subparagraph 100 of the underground floor of the instant building.

(However, in addition to Defendant E, 1/2 shares of each of the six houses including No. 163 of the second floor of the instant building are additionally owned).

Defendant C and D included the leased object of the instant building’s underground floor in Defendant B, E, and January 27, 2010, as well as the part not owned by Defendant B and E. The leased object of the instant building’s underground floor of 100-122, 136-180, 181A-181G 75.

에 관하여 임대차보증금 7,500만 원, 월 차임 800만 원으로 하는 내용의 임대차계약을 체결하고, 2010. 2. 18.경 피고 B, E로부터 위 임차 부분을 인도받아 그 무렵부터 이 사건 변론종결일 현재까지 직업전문학교를 운영하여 왔는데(그 후 2012. 4. 1.경 G로부터 위 임차부분 중 제비137, 146~153호 9개 호실 합계 84.11㎡에 관하여 임대차보증금 300만 원, 월 차임 235만 원에 임차하는 것으로, 2012. 4. 29. 피고 B, E로부터 위 임차부분 중 G로부터 임차한 위 9개 호실과 제비136, 181C~181G 호실을 제외한 나머지 부분 합계 589.13㎡에 관하여 임대차보증금 6,600만 원, 월 차임 715만 원에 임차하는 것으로 각 임대차계약을 체결하였으나, 피고 C, D의 점유 현황에는 변동이 없다), 이 사건 건물 지하층 복도의 일부인 주문 제1항 기재 ㉮ 내지 ㉪ 부분 합계 312...
